Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while being elevated on the forks of a powered industrial truck: (a)C-Ball Masonry Working at Aristokraft, Incorporated Plant Building Additiona, Keystone Street, Littlestown, Pennsylvania - Three (3) employees riding on an unsecured and opensided platform while being elevated to a height of 35 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is the use of a ladder for proper and safe access.
