Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from unintended actuation of a foot pedal/treadle, not protected by a guard: (a)Press Area - Employees operate a Niagara press break set up to bend sheet metal plate and plastic parts, and no means was provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO INSTALL A FOOT PEDAL/TREADLE GUARD. OR IN THE ALTERNATIVE 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by unintended activation of a foot pedal/treadle: (a)Press Area - Employees operate a Niagara press break set up to bend sheet metal plate and plastic parts and no means was provided to protect the foot pedal from unintended activation by falling or moving objects or by someone accidently stepping on it
