General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Mixing Tank #1 - Employees work from a wood pallet on the forks of a Yale fork truck to pour dry chemicals into the #1 mixing tank, approximately fourteen (14) feet above the concrete floor. The pallet is not secured to the forks of the lift truck and no guarding such as guard rails or other approved methods of guarding in place for employee safety. Among other methods, one feasible and acceptable method to correct this hazard is to use the tilting dump bins provided by the employer.
