Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to severe broken bones and/or head injuries: JOBSITE: The employer did not ensure through a visual observation, proper training, an instruction and other effective means that the employee, who was trying to hook up a chain sling from the ground onto the bucket of an excavator, CAT 315 CL maintained proper and effective communication with the operator of the excavator at all times during the process of "hoisting" a rubber mat with the excavator to transport the mat to the blasting site. On or about September 25, 2006, the employee was hit by "descending" bucket of the excavator while performing the above task and sustained severe multiple injuries to one of legs. Among other methods, one feasible and acceptable method to correct the hazard is to: 1. Establish and implement appropriate communication procedures. 2. Train the employees in the proper recognition and avoidance of hazards. 3. Utilize appropriate communication devices and equipment. 4. Utilize other available and feasible engineering technologies.
