Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the "hazards" associated with the hoist operation: WORKSHOP: Employees were using the 1/2 ton Maxwell & Moore Manning overhead "jib" hoist whose arm/jib rotated at 360 degrees, and a section of the wall and structure of an overhead door were used as a means of "stopping" the "swinging arm/jib". Among other methods, one feasible and acceptable means to correct the hazard is to: 1.Follow the manufacturer's/owner's manual recommendations. 2. Install mechanical "stopping mechanisms/devices" on both sections. 3. Comply with ANSI/ASME B30.16-1993; Overhead Hoist (Underhung) guidelines for inspections, maintenance, and operations of the overhead hoist. 4. Utilize other engineering methods.
