Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to chemical fumes and vapors created by the release of freon in the refrigeration unit for the impregnation line due to "power source failures": BASEMENT: Employees were exposed to hazardous chemical fumes and vapors that were generated and released from the Mokon Refrigeration Unit due to electric power failure, and the employer did not have established and implemented preventive measures, such as (but not limited to) an automatic "back up" power system for the unit or an alternative means for the employee protection. On/or about June 16, 2008, the company had experienced electrical power outage, causing the Mokon Refrigeration Unit containing freon shutdown. The unit did not reset by itself upon restoring the electric power, and released and exposed employees to the chemical fumes and vapors. Among other methods, one feasible and acceptable means to correct the hazard is to: 1. Install back up power source/generator. 2. Perform inspections on the refrigeration unit and the impregnation line. 3. Follow the manufacturer's recommendations. 4. Install detecting and pre-warning device(s) for airborne chemical fumes/vapors. 5. Utilize other effective engineering measures.ng
