Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to dust explosion, deflagration and/or other fire hazards due to deficient maintenance, inspection, design and/or operation of the dust collection system for combustible wood dust: Location: Establishment. 1.The employer failed to inspect its combustible wood dust collection system periodically and failed to maintain its combustible wood dust collection system in accord with recommended guidelines and safe practices. For example, the seal of the blower housing/cyclone was leaking, which allowed fine wood dust to escape and become airborne; and the collection ductwork from the Unisaw/Rockwell table saw was crushed and bent and had a hole in it. Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with NFPA 664 (2007) Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities, including: * section 10.2 (Inspection and Maintenance: develop, implement, and document an inspection, testing and maintenance program) 2. The employer failed to prevent and control ignition sources (which can result from static electric charge accumulation and spark a dust explosion or fire) in that: a.There was no electrical grounding and bonding in and between its equipment and the dust collection system (including its ductwork). b.Plastic ductwork -- which is nonconductive -- was used instead of metallic ductwork on the Unisaw/Rockwell table saw. As a result the table saw, ductwork and dust collector were not electrically bonded, could not ensure electrical continuity through the system, and consequently could not dissipate and control the accumulation of static electric charges. c.Nonmetallic flexible ductwork was used in lengths that routinely exceeded the minimum required for machine operations at multiple locations, including the Unisaw/Rockwell table saw, the unbranded swing saw, and the dust storage trailers. Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with NFPA 664 (2007) Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities, including: *section 7.9 (Prevention of Ignition and Control of Ignition Sources - Static Electricity, and in particular 7.9.2 [grounding and bonding of production equipment]) *section 8.2.2 (Duct System requirements, such as: requirement of grounding and bonding of ductwork [8.2.2.2.1.8]; requirement of metallic ductwork and length restrictions for flexible ductwork [8.2.2.2.1.1]; prohibition of nonconductive ducts; 3.The employer permitted combustible wood dust to escape the dust collection system by failing to design and locate exhaust hoods and/or enclosures so as to minimize fugitive dust emissions (as much as possible, without interfering with the safe and satisfactory operation of the machine). Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with NFPA 664 (2007) Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities, including: *section 8.2.2.3 (Hoods and Enclosures requirements)
