Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to crushing injuries from re-setting the stone wall:
1350 BOSTON POST ROAD, GUILFORD, CT:  The employer, prior to allowing an
employee to perform tasks, such as (but not limited to) re-setting
pre-standing stone walls, did
not ensure through not only conducting/checking of conditions of
stones/walls, but also visual
observation, specific instruction and training that the pre-standing
stones/walls were in stable
conditions and the employee was performing the task safely at all times.
On/or about, July 17, 2010, while performing the above task, approximately
5-foot wide section
of the stone wall disturbed, collapsed and fell onto and crushed the
employee who fell on
barbed/wired ground. The employee sustained multiple serious cuts and
bruises to his
fingers/nails, hands, legs, kidney, ribs, and separated collar bone.
Among other methods, one feasible and acceptable method of abatement to
correct this
hazard is to:
1.Establish procedures for re-setting the stone walls on site.
2.Conduct evaluations, inspections, and observations of the process.
3.Provide and require the use of a "buddy system" for the employee
required to re-set the
stone walls.
4.Secure and provide temporary bracing for the stone walls during the
re-setting processes.
5.Provide specific instructions and training.
