Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing injuries while operating and setting up a dock plate onto tractor trailers: WAREHOUSE: The employer did not ensure through not only maintaining the "dock plate" in safe and proper working conditions at all times, but also visual observations, instruction and dtraining that the employee, required to operate and set the dock plate onto the tractor trailers was performing the task safely at all times. On/or about July 07, 2010, an employee, who was in the process of "manually" adjusting to set up the "defective" dock plate to the tractor trailer height while another "individual" was standing on top of the dock plate, sustained severe crushing injuries, broken bones and cuts to right hand fingers. ABATED DURING THE INSPECTION. Among other methods, one feasible and acceptable method to correct this hazards is to: 1. Follow the manufacturer's specifications on the loading dock. 2. Conduct inspections on the loading dock and locking pin. 3. Develop and implement procedures for employees servicing as helpers for the drivers. 4. Perform maintenance on a regular basis. 5. Train employee in the proper and safe operation of dock plate. 6. Follow American National Standard Institute (ANSI MH30.1 - 2000, Revision of ANSI MH30.1 - 1993)), For the Safety, Performance, and Testing of Dock Leveling Devices, Section 4.4 Owner Responsibility.
