Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to crushing injuries and death from
inadvertently being thrown from the operator's seat of the John
Deere JD-450-C Bulldozer as it was being off loaded from an Eager
Beaver transport trailer on or about January 27, 1999. As the
operator's manual states "The use of a seat belt with the optional
John Deere canopy is recommended". One feasible and acceptable
abatement method to correct this hazard would be to have the
employees utilize the provided seat belt in the bulldozer.
