Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries and/or death from being struck by unoccupied heavy equipment such as but not limited to a 1997 John Deere Articulated Wheel Loader, VIN #DW444HX562359 due to a lack of employee training and competency in use of such vehicles: Location: McDermott Road, Branford, CT 06405 On or About April 24, 2001 Among other methods, one feasible and acceptable method to correct this hazard is to develop and implement a written driver qualification program to train employees in the safe use and operation of heavy equipment such as but not limited to front end loaders.
