Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that the
employee who was in a bucket of an aerial lift bucket truck was exposed to
severe contusion,
abrasion and muscle spasm:
WORKSITE - On/About January 16, 2004, the International aerial lift bucket
truck, CT license
H 48975, at 67 Bartlett Lane, Stamford, CT which was used for pruning
various trees at a
residential house slid downward the driveway while an employee was still
in the bucket due to
the following deficiencies.
Subsequently, the bucket of the truck collided with the house and the
employee sustained muscle
spasms.
1.The existing conditions, such as (but not limited to) the down slopped
driveway
that was
covered with snow were not considered.
2.  The outriggers were not firmly and securely placed on the surface of
the ground or firmly
and securely on the industry approved outrigger pads which were firmly and
securely
placed on the ground..
3.  The wheel chocks were not placed under the wheel at a minimum of two
(2) when
conditions warrant, preferably under the rear two (2) wheels.
Among other methods, one feasible and acceptable method to correct the
hazard is to:
1.  Evaluate the surrounding areas and existing conditions prior to
parking and setting up the
truck(s).
2.  Place the outriggers firmly and securely on the surface at all times.
3.  Place more than one (1) wheel chocks under the preferred wheels at all
times.
4.  Train and instruct employees on the above procedures.
5.  Follow ANSI Z133.1-1988 Paragraph 5.2.6; Wheel chocks shall be
installed before using
an aerial lift.
6.  Follow ANSI Z133.1-1998 Paragraph 5.2.18; Booms shall not be operated
unless
outriggers, where required, are down.
7.  Utilize other engineering feasibility.
ABATEMENT VERIFICATION IS REQUIRED AS OUTLINED IN PART 29 CFR 1903.19
