Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with entering into and working in a confined space: SANDPIT ROAD, DANBURY, CT: Where employees were required to enter into the sewage manhole, the employer had not evaluated the workplace/sewage manhole to determine whether or not the sewage manhole was a permit-required confined space in order for the employees to follow proper "confined space entry procedures" if warranted. Among other methods, one feasible and acceptable method to correct the hazard is to develop and implement a confined space entry procedures meeting the requirements of the American National Standards Institute, ANSI Z117.1-1995 and/or the 29 CFR 1910.146, "Permit-required Confined Spaces".
