Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to severe crushing from a caught-in-between point:
WORKSITE: On or about September 12, 2002, the tractor trailer driver was
crushed in between
the storage container and the end of the trailer during the process of
picking up the container
with a Mack Truck Flatbed Trailer.
Among other methods, one feasible and useful method to prevent employees
from the hazards
is to:
1. Implement and enforce a strong and firm enforcement policy.
2. Provide effective training.
3. Provide appropriate equipment and tools, such as (but not limited to) a
block
that has
sufficient strength, thickness and length.
4. Modify the tilt-frame equipment (trailer) and/or the storage container.
5. Comply with the ANSI Z245.1, "The safety requirements for refuse
collecting and
compacting equipment" or a similar ANSI standard involving the section
concerning picking up
and dropping off of the containers.
6. Follow the manufacturer's instruction and manual.
7. Utilize other useful engineering feasibility.
