Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by falling equipment components and flying particles: On or About April 22, 2002, the 1/2 inch X 3, Grade 5 carriage bolt failed securing the 3 3/4 inch metal pulley to the open top metal yoke attached to the hydraulic lifting piston of the Unidex EH Series Lift, Model EH 1050 allowing the spa secured on the carriage of the lift to fall up to 60 inches to the floor. Among other methods, one feasible and acceptable method to correct this hazard was to replace the original yoke, pulley and bolt assemble attached to the hydraulic piston and replace them with the re-engineered, safer closed top yoke, pulley and pin assemble provided by the Unidex Corporation.
