Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of slipping and falling from delivery trucks while accessing the cold storage bays. Worksite: Fender steps were missing in the following instances, exposing employees to the hazards of slipping and falling while accessing the trucks' middle cold storage bay to load and unloading product: 1) Truck #7158: The bottom rear fender step was missing on the driver side. 2) Truck #7186: The bottom rear fender step was missing on the passenger side. 3) Truck #7068: The rear fender step and frame was missing on the passenger side. ABATEMENT NOTE: One method among others to abate this hazard would be to have all damaged or missing steps and frames repaired or replaced. Additionally, a truck inspection program, which would include the condition of the steps and frames, could be developed and implemented.
