Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were improperly riding on the side of earth moving equipment. Location: Corner of First Avenue and Elm Street, West Haven, CT 06516 On or About November 24, 1998 a) An employee was improperly riding on the side of the John Deere 710D backhoe straddling two sections of pipe. Among other methods, one feasible and acceptable method of abatement to correct this hazard is: Do not allow or permit the employees straddle the pipes on the side of the backhoe and instead secure the pipe to the backhoe eliminating the employee exposure.
