General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with operating fork lift trucks without wearing the operator restraint system supplied by the manufacturer. ASME B56.1-1993 Safety Standard for Low and High Lift Trucks, requires manufacturers to provide and operators to wear the operator restraint systems. Outside Chemical Storage Shed: Fork truck operators were operating the Mitsubisihi fork truck without wearing the manufacturer provided operator restraint system (seat belt). Abatement Note: One method among others to abate this hazard would be to develop and enforce a work rule/policy requiring that all operators wear the operator restraint system when operating the fork truck.
