Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees operating
powered industrial trucks were
exposed to the hazard of "ejected from" and "crushed by" powered
industrial trucks:
Jobsite:  On or about August 22, 2008, the operator of the Lull, Model No
844G42 and Serial No 99W21P22-
2109, Highlander Rough Terrain powered industrial truck was not wearing
seat belt or personal restraint
system while operating the powered industrial truck to lift, lower and
transport masonry related materials and
equipment around the jobsite and onto the various elevated scaffold
platforms of the tubular welded frame
scaffolds erected on the south side and west side of the structure being
constructed.
Among other methods, one feasible and acceptable abatement method to
correct the hazard is to:
1. Require all powered industrial truck operators to utilize the personal
restraint systems(seat belts) installed on
the rough terrain powered industrial trucks.
2. Follow the manufacturer's instructions and
