Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling vehicles: (a) Shop Area, Bay #1; The safety latches were inoperable on the lift. (b) Shop Area, Bay #2; The safety latches did not operate on the lift nor did the lift raise/lower evenly. (c) Shop Area, Bay #4; The lift does not raise/lower evenly. (d) Shop Area, Bay #5; There is a severe shake when the lift operates in the raised position.
