Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck and/or crushing hazards: (a) Charging area; Employees are exposed to be accidentally struck by the swing radius of #89 crane/charger as well as fork trucks while walking in this area. The swing radius of #89 charger swings into a commonly used aisle, several fork trucks travel through the same aisle at the same time the charger is in use which increases congestion in the area, thereby exposing employees to being struck and/or crushed by this moving equipment.
