Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries from falling hazard when employees are elevated on platforms when used with a powered industrial truck without fall protection and/or guardrail system: (a) Facility, Back Building: Maintenance employee accesses the 10 ton DeMac overhead crane by standing on a pallet attached to the forks of a forklift without being protected by a fall protection system, thereby exposing employee to a fall hazard of approximately 15-20 feet.
