Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed being struck by defective equipment: (a) West Elizabeth, PA, Maddison Avenue Plant Site; The heavy off-highway equipment had operating and maintenance deficiencies as follows: (1) Terex high lift: The rod was pulled out of the brake can. (2) Lieberr 984: There was no back up alarm and the swing radius of crane was not protected when unloading barges. (3) The Michigan 275 and 175 Front End Loaders leak oil causing the steps to be slippery. (4) Michigan 275 A Front End Loader: There was no portable fire extinguisher available in the cab of payloader. (5) Euclids 98, 99, 91 and Terex 30305 B Dump Trucks: The back up alarms were not functioning properly. (6) Michigan 988 Front End Loader: The access ladder was broken and repaired by twisting wires together. (7) Michigan 275 B Front End Loader: The fan shroud is missing on the engine/cooling fan. (8) Operator's Manuals were not available in cab's of all the off-highway equipment. Among other methods, one feasible and acceptable means of abatement to correct this item is to implement a preventative maintenance program based upon the manufacturer's recommendations.
