Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about March 17, 1996, employees were using a Crown SL-11 parts picker, serial number 208736, with a pallet on its forks to retrieve an item from a storage rack in the Warehouse Department. Adequate fall protection was not provided in that the employee on the pallet was required to disconnect the lanyard from his safety belt so that he could climb over another pallet of material to reach the item. After retrieving the item he slipped and fell from the pallet resulting in severe injuries and eventual death of the employee. Feasible abatement methods could include but are not limited to: 1.Prohibit pallets of material from being placed in the aisles in such a manner that the stock pickers cannot get close to the storage racks. 2.Proper training and enforcement that would require employees to always use their lanyards and safety belts while working in elevated positions. Disclaimers: 1.The employer is not limited to the abatement methods suggested by OSHA. 2.The methods explained are general and may not be effective in all cases. 3.The employer is responsible for selecting and carrying out an appropriate abatement method. IN THE ALTERNATIVE 29 CFR 1910.178(m)(12): Industrial trucks used to lift personnel were not provided with a firmly secured safety platform: The pallet used on the Crown SL-11 parts picker, serial number 208736, on or about March 17, 1996, in the Warehouse Department was not firmly secured to the forks, or provided with restraining means such as rails, chains, etc. or, a body belt with lanyard or deceleration device was not worn by persons on the platform, exposing employees to the hazard of falls from elevations.
