Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing of likely to cause death of serious physical harm to employees: The employer did not protect employees from the recognized hazard of falling off a wooden pallet that was used as a work platform on a forklift. Employees were lifted approximately 12 feet above a concrete surface to install and change out advertising banners. Despite the periodic use of a personal fall arrest system anchored with a lanyard to the load backrest of the forklift, the safe fall distance had not been fully considered for the fall distance. Use of a personal fall arrest system in this manner is not a recognized safe practice. Use of a pallet as a work platform is also not a recognized safe practice. Feasible means of abatement include providing a work platform that is designed and approved to elevate personnel and that is secured to the forks of the industrial truck. Reference information on the design and use of personnel elevating work platforms may be found in Industrial Truck Standards and Development Foundation (ITSDF) B56.1-2005 Safety Standard for Low Lift and High Lift Trucks. Other feasible means to conduct the work include other aerial lift platform devices or the use of a manually propelled rolling ladder.
