P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from the operator's seat and crushed by the industrial truck: A) Warehouse and parking area - The employer did not require the use of the seatbelt/restraint device for a Hyster forklift used to move appliances. Among other methods, one feasible and acceptable method to correct this hazard would be to train operators to utilize seatbelts while operating forklifts and establish a progressive disciplinary policy to enforce usage.e
