General-duty citation text
Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck by hazards; employees working in the south west corner bay, to perform modifications and repairs on a headache rack, to fit a new winch assembly, were required to use an A Frame, clevis type hand hoist, with plain underhung trolley on standard I beam, to lift/support the 2500 lb headache rack while work was accomplished on it; and were thereby exposed to being struck by falling loads that were positioned 28 to 30 inches above the floor. One feasible and acceptable means to abate these conditions would be to ensure that frequent and periodic inspections were conducted by a competent person to determine serviceability of the hoisting assembly prior to authorizing it's continued use.
