Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of falls since the employer permitted employees to work from the load of a Genie Superlift, serial number 9595-00375, in violation of the manufacturer's written prohibition as stated in the Operator's manual and pictured on the equipment in a symbolic decal. One feasible and acceptable abatement method, among others, to correct this hazard is to provide alternative means to access the work area such as, but not limited to, ladders and personnel lifts.nel
