Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling up to ten and one-half feet to the ground below while being raised and transported in the bucket of a J.C. Bramford, 214 Series rubber-tire excavator (backhoe); and while using the backhoe bucket as an elevated work platform in the event of hydraulic system failure, control failure or other unexpected lowering of the bucket. On or about March 15, 2007, an employee was observed as he was lifted with a load of lumber in the bucket of the backhoe, transported with the lumber in the elevated bucket to the structure, and as he unloaded the lumber onto the second floor of Building C of the new Bridgebay Lakefront Condominiums from the elevated bucket. The bucket level was level with the second floor and was measured to be approximately 10 feet, 7 inches. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE METHODS TO CORRECT THIS HAZARD WOULD BE TO: (1) Develop and implement a training program specifically addressing safe operating procedures while using a backhoe and; (2) Instruct employees not to ride in the bucket of a backhoe; (3) Train employees in the recognition of hazardous conditions; and (4) Enforce the safety and health rules established by the employer.
