Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards where a supersack of Azinphos methyl (AZM) was placed in contact or in close proximity to a heated discharge header pipe from two air compressors on or about May 8, 1997. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that pesticides are stored to prevent contact with excessive heat which can affect product stability as specified in NFPA 43D, Storage of Pesticides, Paragraph 3-4.1.
