Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, in the treating plant area at the Glenwood site, the operators of the Daewoo D70S powered industrial truck, ID #32, and the Nisan powered industrial truck, ID #24, were observed traveling throughout the area with their seat belts unbuckled. This practice exposed the operators to the hazard of being ejected and crushed by the machine in a roll-over accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the operators to wear their seat belts at all times when they are sitting in the seat of the powered industrial trucks, regardless of the length of time that they will be in the seat.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, below the sorting machine, employees operating the Poulan 3300 Timbermaster chain saw, serial number 5300376 without the benefit of a chain brake or a bar tip guard, a condition that exposed them to the hazard of being struck by the chain in the event of a kickback. ANSI B175.1-1991 "Safety Requirements for Gasoline-Powered Chain Saws" requires that the chain saw be equipped with a chain brake that stops the rotation of the chain in the event of a kickback or a bar tip guard that covers the kickback area of the bar and chain. Among other methods, one feasible and acceptable abatement method to correct this hazard is to purchase only those chain saws equipped with chain brakes or bar tip guards. A second feasible and acceptable abatement method to correct this hazard is to retrofit the saw with a chain brake from the manufacturer.red

ANSI B175.1-1991 "Safety requirements for Gasoline-Powered Chain Saws" requires that the chain saw be started on the ground or where otherwise firmly supported. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the operator to place the saw on the ground, position one foot on the base of the handle, grip the upper handle with one hand and pull the starting cord with the free hand. A second feasible and acceptable abatement method to correct this hazard is to require the operator to firmly support the chain saw before starting, such as gripping the throttle handle between the knees, gripping the upper handle with one hand and pulling the starter cord with the free hand. A third feasible and acceptable abatement method to correct this hazard is to require the operator to firmly support the chain saw before starting by placing the saw on a stable surface such as a log, block of wood, etc.
