Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to high concentrations of aluminum fume. At the worksite: On 6/8/95 three employees were over exposed to hazardous levels of aluminum fume while welding. One employee was welding aluminum tank parts, including welding in a confined space, 14.46 mg/m3 (twa). One employee was welding tank parts, 6.52 mg/m3 (twa). The third employee was cutting aluminum to fabricate aluminum parts using a plasma cutter, 7.32 mg/m3 (twa).
