Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazards of overturning and/or being struck by the Genie personnel lift , serial number 1485-10418S, on or about 3/23/93, while employee(s) were operating the lift without required outriggers, stabilizers and leveling jacks outside the Holiday Inn Northwest. One feasible and acceptable abatement method, among others, to correct this hazard is to inspect the location where work is to be performed to ensure that no obstructions will interfere with the installation of the outriggers and to stricktly enforce the manufacturer's installation guidelines. When the work area's dimensions preclude the use of the equipment's safety features, an alternative such as properly construced scaffolding could be used. (b) The hazards of overturning, mechanical failure, and or being struck by the Genie personnel lift, serial number 1485-10418S, on or about 3/23/93, in that a copy of the manufacturer's operating manual was not available to train employees in the operating and maintenance procedures. One feasible and acceptable abatement method, among others, to correct this hazard is to keep a copy of the manual in its designated place on the lift and prohibit employees from operating the lift until they have read and understood the inspection, maintenance, operational and other required procedures, such as but not limited to the following: 1) Prohibiting horizontal loading by pushing or pulling from the lift or draping hoses over the sides of the basket; e.g., using 1500 p.s.i. sprayer against wall. 2) Preventing moisture on the battery tops and hold downs; 3) Inspecting, maintaining and properly assembling the Genie lift.
