Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of falling from a bulldozer. An Employee was crushed by a Holt/Cat 955L bulldozer when the seat latching mechanism failed as the equipment was exiting a 4 foot (1.37 m) trench. The seat latching mechanism was missing a spring on the latch assembly. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to enforce and establish the following procedures. 1. Have the seat latch assembly spring replaced. 2. Develop a written preventive maintenance program to include the seat spring assembly latch and schedule inspections to ensure its effectiveness.
