Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Inadvertent entrapment of the operator's head and/or torso between the
truck and the ground in
the event of a tip over, causing injury or crushing the operator to death.
Among other methods,
one feasible and acceptable abatement method to correct this hazard is to
establish and enforce
an adequate plant safety restraint system procedure as referenced by:
ASME/ANSI B56.1d-1992
ADDENDA to ASME/ANSI B56.1-1988, Part III, Section 7.39, American National
Standard
of Safety Standards for Low Lift and High Lift Trucks;  Clark Rules for
Safe Industrial Truck
Operation booklet "THE NEW PROFESSIONALS", page 35, 46 and 47;  FLI
Learning
Systems, Inc. Instructor Guide "COACHING THE LIFT TRUCK OPERATOR";  Parlay
International Safety Sheet "WORKING SAFELY ON FORKLIFTS".  Essential
element of a
safety restraint system procedure would be:
1.Always buckle up the seat belts.
2.If the truck starts to tip over, don't jump.
3.Stay in your seat, grip the wheel, brace your feet and tip with the
truck.
