Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of a crushing injury due to being caught between the boom and/or any portion of the 35 ton Grove Mobil Hydraulic Crane Model RT65S, P#42598, serial number 42598 and/or the load being hoist. Crane was being operated on the east side of the new extraction building and the south side of the plant property: (a) Among the methods, one feasible and acceptable abatement method for correcting this hazard would be to provide a firm footing by means of mud skids, substantial timbers, cribbing or other structural members sufficient to distribute the load so as not to exceed safe bearing capacity of the underlying material, as required by Paragraph 15.-3.4.3 of American National Standard- ANSI B 30.15-1973, Mobile Hydraulic Cranes.
