Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the recognized hazard of being struck by falling portions
of the hoisted load of
the 1960 Linkbelt LS-989 Crawler Crane.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
that the boom-hoist pawl or other positive locking device shall be engaged
in accordance with
Section 5-3.2.3(q) of the American National Standards Institute (ANSI)
B30.5-1968, Crawler,
Locomotive and Truck Cranes.

5(a)(1) Rational:
1. The boom hoist pawl locking device was not maintained in sufficient
operating condition.
2. No service/maintenance inspection records for 1960 Linkbelt LS-989
Crawler Crane were
maintained.
3. No competent person inspected crawler crane prior to use.
4. The insufficient maintenance of the boom hoist pawl resulted in the
dropping of the load.
5. The feasible method of abatement would be to replace boom hoist pawl.
