Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)receiving a greater degree of burn from the employer not providing an adequate means of emergency treatment for the eyes or body of an employee who has been exposed to molten asphalt on the site. Among other methods, one feasible and acceptable method for abatement is to provide emergency eyewash and shower equipment at a distance no greater than 100 feet (30.5 meters) and no more than 10 seconds away from the possible points of exposure as is required by ANSI Z358.1.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)death and/or burns from violent frothovers/boilovers due to water not being removed from tank 13 prior to filling that tank with asphalt and then heating that asphalt above the boiling point of water. Among other methods, one feasible and acceptable method for abatement is to following the asphalt Institute, IS180, has a recommended guideline of draining off accumulated water prior to adding or withdrawing asphalt from an inactive tank. Another is following API Publication 2028-2.5.3 - Tanks that have been out of service for extended periods should be checked to ensure that water bottoms have not accumulated.
