Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazards of overturning and/or being struck by the Genie Personnel lift, serial number 1487-13775-S, on or about 11/14/94, while employees were operating the lift without required outriggers, stabilizers and leveling jacks inside the San Antonio Marriott Rivercenter Grand Ballroom. Employees were putting up displays. One feasible and acceptable abatement method, among others, to correct this hazard is to insure the outriggers are installed and to strictly enforce the manufacturer's installation guidelines.
