Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the recognized hazard of being struck by falling portions
of the hoisted load and
boom of the 165 ton American Model 9299 Crawler Crane, serial# GS14108.
a)   Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to ensure that the total lifted load including rigging does not exceed
the rated load for
the crane for the specified load radius in accordance with section
5-3.2.1-a of the
USA Standard(USAS) B30.5-1968, Crawler, Locomotive and Truck Cranes.
b)   Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to ensure that substantial timbers, cribbing, or other structural
members
sufficient to
distribute the load so as not to exceed safe bearing capacity of the
underlying material in
accordance with section 5-3.4.6 of the USA Standard (USAS) B30.5-1968,
Crawler,
Locomotive and Truck Cranes.
