Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazards of being struck by falling portions of the hoisted load or hoist of the Jet 1 Ton electric hoist located in the production area adjacent to the Hyd-Mech Model 20 band saw. Among other methods, one feasible and acceptable method for abatement is to ensure that the rated load of the hoist is plainly marked on each side of the hoist bridge in accordance with Paragraph 16-2.1.1.1 of The American National Standards Institute B30.16-1973, Overhead Hoists.
