Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)crushing injuries and being struck-by a by a John Deere 624H Loader, where on or about February 15, 2000 at 18201 Egret Bay Blvd, Houston Texas an employee was guiding an eight feet concrete pipe with his hands while the loader transported the pipe; the employee slipped and was run over by the loader. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to remove all personnel out of the area while the machine is being operated. Hazard: increased probability of injury/death.
