Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)The hazard of being crushed by the powered industrial truck while operating the Clark, No. 504088, Serial 10240, did not use/wear the installed seat belts. The employee operated the Clark truck on or about April 14, 1999 in the warehouse. One feasible and acceptable abatement method, among others, to correct this hazard would be to have operators wear the provided seat belt and enforce the procedure.
