Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Fire and explosion hazards on or about July 21, 1998, because fuel (trimethylhydroquinone), oxygen or ignition source was not adequately controlled when trimethylhyroquinone was being charged to the system at the plant. Among other methods, one reasonable and feasible method of abatement is to provide oxygen analyzers to the equipment so operators could monitor the oxygen concentration in the system to control the explosion hazard of the trimethylhydroquinone. Another feasible method is to control the oxygen level within the system by using nitrogen.
