Title 21 V.S.A. Chapter 3, Subchapter 5, Section 223(a) Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Location: Job site, P & H Truck Stop - US Rte. 302, Newbury VT Violation: On or about May 8, 1995, an employee was observed riding in the bucket of a Cat 215LC excavator, above a trench up to 13 feet deep. Among other methods, one feasible and acceptable abatement method would be to train employees not to ride on any machine not designed or equipped to carry passengers.
