NYSLL Article 2, Section 27(a)(3a)(1):  The employer did not furnish to
each of its employees,
employment and a place of employment which is free from recognized hazards
that were causing
or are likely to cause death or serious physical harm to its employees and
which will provide
reasonable and adequate protection to the lives, safety or health of its
employees:
NYSDOCS Shawangunk Correctional Facility employees were exposed to the
hazard of
being infected with Mycobacterium tuberculosis through unprotected contact
with inmates who
were infectious or suspected to be infectious with tuberculosis in that
some employees were not
proved with TB skin tests annually.
Feasible and useful abatement methods for reducing this hazard, as
recommended by the
CDC, include, but are not limited to:
a.)TB skin testing shall be conducted every three (3) months for
workers in high risk categories, every six (6) months for workers
in intermediate risk categories, and annually for low risk
categories (See MMWR "Guidelines for Preventing the
Transmission of Mycobacterium tuberculosis in Health-Care
Facilities, 1994).ties,
