Sec.27-a(3)(i): The employer did not furnish employment and a place of
employment which
were free from recognized hazards that were causing or were likely to
cause death or serious
physical harm to employees in that employees were exposed to the hazard of
being struck by
a falling vehicle, in the event of hydraulic failure of the twin post
Rotary hydraulic vehicle
lift, Model #STP4-E, Serial #A4R, while servicing vehicles in the garage.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to equip the lift with a mechanical device to hold the lift in the
fully extended position as
recommended by the American National Standards Institute and the
Automobile Lift Institute
in the industry consensus standard ANSI/ALI B153.1: Safety Requirements
for the
Construction, Care and Use of Automobile Lifts". The device should have a
strength factor
of not less than 3, based on the rated load capacity of the lift.
a) Rotary hydraulic lift was not provided with mechanical stops to prevent
the lift from
falling in the event of a hydraulic failure - crushing hazard.
