North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by equipment. a)Construction site, Highway I-85 - Employee operating a DRESSER ROLLER/COMPACTOR in close proximity to an unguarded embankment that was sloped to approximately 30 degrees without being provided with protection against rollover of equipment. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO PROVIDE THE ROLLER/COMPACTOR WITH A ROLLOVER PROTECTION SYSTEM.
