North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)establishment, service department, north wall, automotive lift #11 & #13- struck by falling hydraulic inground lift. Employees were allowed to work around and under inground lifts while performing maintenance and or repairs to vehicles when safety locking devices were not working on lifts provided with safety locking devices. b)establishment, service department, automotive lifts- manufacturer's rated load capacities were not posted. c)establishment, service department, automotive lift #5- safety latch on left side does not engage properly. (Reference: Automotive Lift Institute publications "Lifting it Right", SM-89-1, "Safety Tips", ST90, and ANSI/ALI B153.1-1990) Feasible and acceptable abatement methods to correct the hazards would be to ensure all safety latches installed on lifts were working properly, and all lifts had manufacturer's rated load capacities posted.
