North Carolina General Statute 95-129 (1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees:
a)in that at the time of the incident on Jan. 30, 1998 provisions were not
taken to
ensure that work areas where outside contractors were performimg overhead
work
were isolated,marked,barricaded or guarded to prevent employees from
entering
construction work area and to prevent the operation of moving equipment
such
as an overhead crane in the work area.
Among other methods to correct this hazard is to isolate, mark, barricade,
or otherwise guard
the areas in which outside contractors are working and to establish
specfic written procedures
to prevent employees from entering the area and to prevent the operation
of
moving equipment
such as an overhead crane in the area.
